FICA Reimbursement
Bridgeport Hospital did not file refund claims for any periods prior to April 1, 2005 for which the IRS is now making tax refunds available. For tax paid during those periods Bridgeport Hospital did not file claims preserving a right to a refund because of the substantial uncertainty surrounding whether a refund could be had. It bears emphasis that the IRS won the majority of the court decisions that came out during 2005, 2006 and 2007 -- including decisions in the Albany Medical Center and Memorial Sloan-Kettering cases that were decided in early 2007 in the federal trial courts in New York. Some professional advisors advised teaching hospitals that it would be a waste of time and money to file tax-refund claims. Only with hindsight does it appear that teaching hospitals were destined to win their twelve-year battle with the IRS. Therefore, unless an individual resident has filed claim on their own, the statute of limitations has passed for both the resident and the hospital.
